1. About these Terms

kdt consulting is the registered business name of Kimberley Dawn Tomasson, a sole proprietor in Vancouver, British Columbia, Canada ("we" or "us"). Through kdt-consulting.com and smartchoices-betterdecisions.com (together the "Website"), we offer philosophical and ethics consulting, workshops and sessions (the "Services"). By using the Website, you agree to these Terms. Our Privacy Statement at smartchoices-betterdecisions.com/privacy-en forms part of them. Private workshops and paid individual sessions are also governed by the Release and consent form you accept in Jane, and work for organisations by our written agreement. If one of those documents conflicts with these Terms, that document applies.

2. Using the Website and our Services

The Website and Services are for adults aged 19 and over. You agree not to use the Website unlawfully or harmfully, try to gain unauthorised access, upload harmful code, scrape or copy content by automated means or use it to train AI models, or misrepresent who you are. We may suspend access for anyone who breaks these Terms.

We offer free 15-minute introductory meetings (booked through Google Calendar), private workshops and paid individual sessions (booked through Jane, in person or online), and work for organisations (under a written agreement). Our Services are philosophical and ethical conversation and education. They are not therapy, counselling, or medical, psychological, legal or financial advice, and we are not a health care provider. If you need that kind of help, please see a qualified professional. If you are in crisis, call 911 or your local emergency number.

You remain responsible for your own decisions. Descriptions, prices and availability may change, and we may decline or end a booking where the Services are not a good fit.

3. Booking, payment, cancellations and refunds

Workshops take place in Vancouver (various locations), private sessions on West Broadway or online by video. A booking is confirmed when you receive a confirmation email from Google Calendar or Jane. Before your first private workshop or paid session, you must accept our Release and consent form in Jane.

Payment. Prices are in Canadian dollars and do not include applicable taxes such as GST. We accept card payments through Helcim (emailed link or in-person terminal), Interac e-Transfer to ktomasson@kdt-consulting.com from a Canadian bank account, and, for organisations, invoice or bank transfer on net 30 terms. Payment is due before workshops, and within 24 hours of the invoice for private sessions. We never see or store your full card number. Your bank may charge conversion fees if you pay from outside Canada.

Cancellations. You may cancel or reschedule an individual session up to 48 hours before it starts at no charge; later cancellations and missed sessions are charged in full. Private workshops cancelled 3 or more days before the start are fully refunded. Organisations follow their written agreement. If we cancel, we will offer a new time or a full refund.

Refunds. Otherwise, fees for Services already delivered are not refundable. Approved refunds go to your original payment method within 10 business days. Nothing here limits refund rights you have under consumer protection law where you live.

4. Our content and copyright

All content on the Website and in the Services, including text, workshop materials, handouts, images, videos, audio, logos and design, is owned by us or used with permission, and is protected by copyright law. You may view the Website for your own personal information and share links to its public pages. You may not download, print, save, screenshot, record, copy, republish, sell, modify or use any of it commercially, or remove any copyright notice, without our prior written permission. Materials we give you during the Services are covered by the limited personal licence in our Release.

If you believe something on the Website infringes your copyright, email ktomasson@kdt-consulting.com with your contact details, a description of your work, the web address of the material, and a statement that you own the copyright or act for the owner. We will review it promptly. You may also report it to Squarespace, our host.

5. Liability and third-party services

The Website is hosted by Squarespace and links to Google Calendar, Jane and LinkedIn; payments run through Helcim or your bank. Their own terms and privacy policies apply, and we are not responsible for their content, availability or practices.

The Website and its content are provided "as is" for general information, without promise that they are error-free or always available. To the extent the law allows, we are not liable for indirect, incidental or consequential loss, and our total liability for any claim is limited to the amount you paid for the Service it relates to, or CAD $100 if you paid nothing. These limits do not apply where the law does not allow them, such as for gross negligence or wilful misconduct, and do not affect your statutory rights as a consumer. The Release you accept in Jane also applies to private workshops and paid sessions.

You agree to compensate us for reasonable losses, including legal costs, resulting from your breach of these Terms or misuse of the Website.

6. Governing law, changes and contact

These Terms are governed by the laws of British Columbia and the federal laws of Canada that apply there, and disputes will be decided by the courts of British Columbia. If you are a consumer living elsewhere, you keep any protections your local law gives you that cannot be waived, including the right to bring a claim in your home courts. If you have a concern, please contact us first; most can be resolved by talking them through.

We may update these Terms; the new version applies from the date posted here, but not to Services you have already booked and paid for. If any part of these Terms is unenforceable, the rest still applies, and if we do not enforce a term right away, we can still enforce it later.
